4. User Accounts and Registration

To use certain features of our Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

6.1 Professional Requirements

• Comply with all applicable employment and healthcare regulations

• Process payments in accordance with agreed terms

7.2 Job Postings

Job postings must accurately represent the position, requirements, and working conditions. Facilities are responsible for ensuring all posted positions comply with applicable laws and regulations.

8. Payment Terms

8.1 Service Fees

HealthShift charges fees for certain services as outlined in our pricing structure. All fees are non-refundable unless otherwise specified in writing.

8.2 Payment Processing

Payments are processed through secure third-party payment processors. You agree to provide accurate payment information and authorize us to charge your payment method for applicable fees.

8.3 Professional Compensation

Compensation for healthcare professionals is determined by the facility and professional. HealthShift facilitates payment processing but is not responsible for payment disputes between facilities and professionals.

9. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

We comply with applicable data protection laws, including HIPAA where applicable, and implement appropriate security measures to protect your information.

10. Intellectual Property Rights

The Service and its original content, features, and functionality are owned by HealthShift and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of content you submit to the Service. By submitting content, you grant HealthShift a non-exclusive, royalty-free, worldwide license to use, modify, and distribute such content in connection with the Service.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. HEALTHSHIFT DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

HEALTHSHIFT DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEALTHSHIFT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

IN NO EVENT SHALL HEALTHSHIFT'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT PAID BY YOU TO HEALTHSHIFT IN THE TWELVE MONTHS PRECEDING THE CLAIM.

13. Termination

You may terminate your account at any time by contacting us or using the account deletion feature in your account settings.

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
